Udta Punjab, Nihalani, Nehru and the case for less censorship in a democracy

What has escaped attention during the boiling outrage over Udta Punjab is the bizarre state of film censorship in India.

To take recent examples, Quentin Tarantino's mystery thriller The Hateful Eight (2015) which featured Samuel L Jackson and Kurt Russell, was randomly hacked by Pahlaj Nihalani-led CBFC ostensibly because of its "gory scenes and violence against women."

Curiously, while some cuss words like "bitch" and "whore" were beeped out, the character Daisy (played by Jennifer Jason Leigh) getting punched in the face a dozen times was allowed to pass. Perhaps those weren't violent enough. 'Penis' made it through but allusions like 'pecker' and 'johnson' didn't. Details of the censor certificate are here.

If that isn't bizarre enough, consider that in the same day thatThe Hateful Eight was released, Oscar contender The Danish Girl came out with zero cuts or blurs even though it depicted a minute-long scene with full frontal nudity.

Tom Hooper's 2015 British-American romantic drama got Alicia Vikander an Oscar for 'best performance by an actress in a supporting role' and it featured copious scenes of nudity, transsexuality and kissing which were allowed to pass with just an 'A' certificate. Why? Apparently because Nihalani thought the filmmakers "didn't go overboard with nudity."

Remember, he is the same man who clipped James Bond's kiss by "20 seconds" in Spectre because, to quote him, it was akin to "doing sex in your house with door open. And show to people the way you are doing sex."

But it will be unfair to pick on Nihalani even though the CBFC chairman has shown a repeated penchant for making himself a butt of ridicule.

The issue, as multiple national award-winning filmmaker Shyam Benegal had pointed out in an interview to Firstpost: "the tragedy of censorship in our country is that often, personal biases and prejudices come in the way of evaluating films for the Indian audience… The gulf between the urban and non-urban, the metropolitan and non-metropolitan audience…the guidelines of the censor board are too rigid to be applied to this diverse audience."

Benegal, who heads the government-appointed revamp panel of CBFC, watched Abhishek Chaubey-directed Udta Punjab on Wednesday and found it to be a “laudable effort”.

“It’s a well-made film. It brings to attention a very serious problem, that of drug use among young people, which can, if we are not careful, become a rampant problem. It’s a laudable effort... But people are misreading the film,” he said. “They are under the impression that it is anti-Punjab. I don’t think the film is anti-Punjab at all,” he was quoted, as saying by news agency IANS.

This raises a bigger debate over the need, at all, for having censorship in films and Union Information and Broadcasting minister seemed to be hinting at a more liberalised norm and radical changes soon.

Speaking at the CNN News18 Indian of the Year Award show on Thursday, Arun Jaitley said: "You will probably have a system where you will have to have a certificate. The correct word is certification and not censorship. Certification norms will have to be liberal.

The Benegal committee, he said, has suggested some changes. "There is a well documented report by Shyam Benegal, the first part of which has come to me which is under consideration. Over the next few days, we are going to announce some very radical changes in that," he said.

The idea of censorship in film, books or works or art stems from an inherent hypocrisy in a democracy based on a Constitution that promises liberty of thought and expression.

The problem, of course, started with India's first Prime Minister Jawaharlal Nehru, whose government in its first 14 years amended the Constitution 17 times. The First Amendment — carried out within 18 months — added restrictions on freedom of expression, guaranteed under Article 19(1)(a), to suppress extremist publications for public order.

A Time magazine report of 28 May 1951, reproduced by R Vaidyanathan in Firstpost here, said “Part of the Indian press, said (Nehru), is dirty, indulges in ‘vulgarity, indecency and falsehood.’ To teach it manners, Nehru proposed an amendment to India’s constitution that would impose severe restrictions on freedom of speech and expression."

Once that Rubicon was crossed, there was no stopping anyone from misusing the law or to use censorship as a political tool as it has been in Udta Punjab's case.

If it is spurious, the government can and should ban a packet of mustard oil, else consuming it may make us sick. But a movie isn't a packet of oil or a bar of soap. It is an idea. And it is decidedly stupid to ban ideas because they cannot be banned in the first place.

It is preposterous to think — as the CBFC has done repeatedly in the past — that by muting or beeping out expletives anyone can be prevented from being exposed to it. Apart from the fact that there is no empirical data to show a correlation between a violent movie and a murder or a sexually explicit movie and a rape, the fact is that Internet has made it absolutely impossible for any idea to be censored.

But there is a larger debate still. Why should we let anyone, including the government, decide what is good or bad for us? This is a personal choice, a guaranteed right (albeit qualified). Why should we let any agency usurp that right?

Apart from the fact that artistic freedom and creative expression are as precious as audience's right to make informed choices, censorship in a democracy impacts the very basis of a free society — the principle that each and every individual has the right to decide what art or entertainment he or she wants — or does not want — to receive or create.

When a government censors a movie or bans a book or work of art, it sends out a message that if the contents were to be exposed to public, that would either be morally corrupting or result in some grave physical damage. This is an exceedingly problematic position.

There is zero evidence to show that a movie or a work of art induces someone to carry out a murder, rape or other crimes. On morality, if we suppress material based on the actions of unstable people, no films, work of fiction, or art would be safe from censorship. Psychopaths, for instance, justify their acts of violence while citing the Bible.

Studies on the relationship between violence in media (used in its wider sense) and in real life have proved inconclusive. In fact, there is no statistical correlation between the two phenomena. Many human behaviouralists believe, for instance, that violence and sexually explicit art and entertainment have a useful and constructive societal role, serving as a vicarious outlet for individual aggression.

Also, where does one draw the line the sand? What one may find offensive may not be so to me. What gives one the right, then, to prevent me from consuming it? However, while I may not be stopped, one may very well choose not to consume it. So an absence of censorship actually makes for a freer society where we are guided by choice, not compulsion.

Top 10 Affordable New Models Of 2016

Last month we brought you the Top 10 Most Anticipated Bikes of 2016. For February, let’s take a look at the most affordable new bikes of 2016, because, well, a lot of the bikes in that other list are pricey: XDiavel, Brutale 800, Super Duke GT … you get the picture. There already exist a lot of motorcycles in the sub-$10k price category, and here’s 10 more new models joining that list. From retro to modernistic, cruiser to sportbike, on-road to off, there’s a little something for everyone in this list.

A few of the prices we had to guesstimate due to the unavailability of an official MSRP, butMO editors have won the Price is Right Showcase Showdown 32 times, so we’re fairly confident in our pricing prognostications. We’ll begin with the most expensive bikes on the list and work our way down. Let’s kick this list off with two very similar new models from Moto Guzzi.

10. Moto Guzzi V9 Bobber & Roamer

At $8,990 the V7 II Stone is the most affordably priced model in the Moto Guzzi lineup, and winner of our HepCat TooCool Millennial Shootout. Producing only 41 horsepower and 40 lb-ft of torque from its 744cc, the V7 II is somewhat underpowered. With the announcement of a new 850cc V-Twin engine – the V9 – powering two new models, Bobber and Roamer, we’re expecting big things from the two new bikes.

9. Indian Scout 60

So impressed were we with the first Indian Scout we named it our 2015 Motorcycle of the Year. For 2016, Indian is following up the success of the Scout with the more affordably priced Scout 60. What’s the difference between the two? For $2300 less ($8,999 vs $11,299) the Scout 60 comes with one less gear (five vs six) and 134 fewer cubic centimeters (999cc vs 1133cc).

8. KTM 690 Duke

It may just be a glorified thumper, but KTM’s 690 Duke is certainly the overachiever in this list. At $8,999 the new 2016 model retains the same MSRP of the old 690 Duke it’s replacing.

7. Triumph Street Twin

It’s almost impossible for 2016 to be a bigger model year for Triumph than it already is. This year the Hinckley factory will launch  two new Speed Triples, an expanded family ofExplorers, three new engines powering five new Bonnevilles, and then there’s the recentspy photos of another new Bonneville. The most affordable among all of these is the newStreet Twin – an $8,700 Bonneville powered by a new liquid-cooled 900cc parallel-Twin. “The OG British Superbike, circa 1965, takes on an entirely new character in the new Street Twin, a modern classic set to inspire a new generation,” says old-is-new-again editor, Burnsie, in his 2016 Triumph Street Twin First Ride Review.

6. Yamaha XSR900

The XSR900 is the third iteration utilizing Yamaha’s potent 847cc liquid-cooled DOHC inline three-cylinder. Both the FZ-09 and FJ-09 have won numerous shootouts here at MO and, since the mechanically alike XSR is largely a styling exercise, it should exhibit similar performance qualities and continue the Triple’s winning tradition. Yamaha is releasing the pricing details February 16, but knowing the 2016 FZ-09 retails for an incredibly affordable $8,190, we’d be surprised if the XSR’s price strayed far from that figure. Even Vale seems to think this is a cool new bike.

5. Ducati Scrambler Sixty2

Eight grand for an air-cooled 400cc motorcycle seems a little steep to us, but theScrambler Sixty2 is a Ducati and it’s cool. So, maybe that’s all it needs to demand its premium asking price. It’s $7995 MSRP got it to fifth place in this Top 10, though, so the Sixty2 remains a relatively affordable new model for 2016. But don’t take our word for it. Here’s a lovely video chock full of surfing, skating, motorcycling millennials having the time of their lives with the Scrambler Sixty2.

4. Suzuki SV650

According to Suzuki, the new SV650 is returning to all the elements that made the original SV a cult classic – but with more of everything. The 645cc liquid-cooled V-Twin has been updated with more than 60 new parts, boasting more low-to-mid range horsepower and torque, as well as improved fuel economy and lower emissions. The SV’s updated chassis incorporates more than 70 new parts and components, and when combined with the new steel truss frame, equals a weight reduction of 15 pounds over the previous model.

Like Yamaha and its XSR900, Suzuki is keeping a tight lip on the SV650’s retail price. We can, however, approximate from the $7,599 MSRP of the Kawasaki Ninja 650 ABS that to remain competitive, the new SV should be priced somewhere near the Ninja. We estimate the SV will be priced around the $8,000 mark. New SVs are targeted to be available in dealers in late spring to early summer.

3. Honda CBR500R

The 2016 Honda CBR500R was aggressively restyled to more closely resemble itsCBR600RR and CBR1000RR counterparts. In addition to its new styling, the CBR500R also receives new LED headlights and taillights, a lighter muffler design for better mass centralization and an “improved” exhaust note, according to Honda. Other additions include an adjustable front brake lever, smoother gear change feel, a larger fuel tank with hinged cap, and preload-adjustable front suspension. The 2016 Honda CBR500R will be available in Red, Matte Black Metallic and Pearl White, starting in early 2016 with an MSRP of $6,499.

2. BMW G310R

BMW’s forthcoming G310R will be the smallest displacement motorcycle in the OEM’s model lineup since forever. With S1000R styling cues, and powered by a 313cc Single with a slightly rearward canted cylinder and reverse-mounted cylinder head, the G310R is looking to make a splash in the small-displacement category. But, as editor of all things tiny, Troy Siahaan points out in his BMW G310R Versus The World article, the G310R is joining some already established models as well as a few more new ones that will most likely be joining the fun soon. BMW hasn’t announced the G310R’s pricing, but to be competitive against the likes of Honda’s CB300F ($3,999) or KTM’s 390 Duke ($4999) it should be $5k or less (Honda’s CB500F is $5,799). As soon as BMW releases the G310R’s MSRP, we’ll let ya know.

2017 Yamaha FZ-10 Announced For Canada

Yamaha Motor Canada has announced it will offer the MT-10, bringing it over under the name FZ-10 as an early 2017 model. As of this writing, Yamaha’s American arm has not made an official announcement for the U.S. but we expect one shortly.

In Canada, the FZ-10 will retail for CN$15,499 (US$12,055). That puts it CN$3500 lower than the 2016 YZF-R1 and $1200 less expensive than the YZF-R1S.

The FZ-10 is powered by an 998cc Inline-Four derived from the R1/R1S engine. As with the R1, the FZ-10 uses four-valve cylinder head design but uses 31 mm steel intake valves instead of the 33 mm titanium intake valves on the superibike (the 26.5 mm steel exhaust valves are the same however). Intake and exhaust cam profiles and timing were altered to improve low-to-mid-range torque and power.

The engine still uses a crossplane crankshaft, but it’s heavier than the one on the R1 for improved control at low engine speeds. Yamaha modified the pistons and combustion chamber and compression ratio to make the engine more street-friendly. The FZ also uses a single set of injectors compared to the twin-injectors on the R1.

Yamaha claims a peak output of 81.8 lb-ft. at 9000 rpm for the FZ compared to 83.2 lb-ft. at 11,500 rpm for the R1. No horsepower numbers were released for the Canadian-spec FZ-10, but considering the peak torque is the same as the European specifications, we expect horsepower to be similar to the 158.2 hp at 11,500 rpm claimed on the other side of the Atlantic.

A Yamaha Chip Control Throttle handles the fueling, offering three power modes to go along with three levels of traction control. Cruise control is standard, working at speeds from 50-160 kph (31-100 mph) in fourth gear or higher.

The chassis is comprised of the R1’s deltabox frame but the rear subframe is steel instead of magnesium, so it can better support the extra weight of luggage (sold separately, of course).

The fully-adjustable KYB fork is based on the R1’s unit but with slightly revised settings. The rear wheel is suspended by a fully-adjustable monocross KYB shock with piggy-back reservoir. Both front and rear suspension offer 4.7 inches of travel.

Braking ability is provided by radial-mount four-piston calipers gripping twin 320 mm discs up front while a Nissin single-piston caliper squeezes the 220 mm rear disc. ABS is standard.

Other features include a steering damper, full LED lighting, digital LCD display, 12-volt DC connector, a 4.5-gallon fuel tank and a claimed wet weight of 463 pounds. Canadians will have a choice between a Matte Dark Metallic Gray with Black paint scheme or the Bluish Gray with yellow wheels.
